Terms and Conditions of Use and Sale

1) Purpose
These terms are intended to define:
- The rules for accessing and using the Fluencygo.io website (the "Terms of Use")
- The conditions of sale applicable to the purchase of digital services offered on the Site (the "Terms of Sale")

3) Definitions
- Site: the website accessible at Fluencygo.io
- User: any person browsing the Site
- Registered User: any person who has created an account and/or logs in
- Services: digital services offered for sale via the Site (platform access, features, digital content, etc.), as described on the offer page at the time of purchase
4) Acceptance of Terms
Use of the Site implies acceptance of the Terms of Use.
Any purchase implies acceptance of the Terms of Sale at the time of ordering.
5) Site Access
The Site is normally accessible at all times. However, the Publisher may suspend, limit, or interrupt access for maintenance, updates, or when necessary (security, incidents, etc.).
6) Account Creation and Security
Some features require creating an account.
The Registered User agrees to provide accurate information and maintain the confidentiality of their credentials. Any activity performed from the account is deemed to have been performed by the Registered User, unless proven otherwise.
7) Cookies, Personal Data, No Analytics
- For non-registered visitors: the Site only uses strictly necessary cookies (operation/security)
- Personal data is only processed for users who register and/or log in (account management, authentication, security)
- The Site does not use any analytics tools

9) Order
9.1 Process
Orders are placed online: offer selection, summary, acceptance of Terms of Sale, payment.
9.2 Payment Obligation
In accordance with applicable e-commerce rules, final order validation must include a clear indication of the payment obligation (e.g., "Order with payment obligation").
9.3 Confirmation
An order confirmation is sent electronically (e.g., email) after validation.
10) Price and Payment
- Applicable prices are those displayed on the Site at the time of order (except for obvious errors)
- The total price due (including any taxes/fees) is indicated before final validation
- Payment is due immediately upon ordering, using the methods offered on the Site
11) Service Delivery
The delivery methods (platform access, activation, access duration, etc.) are specified on the offer page and/or in the confirmation email.
12) Right of Withdrawal (Consumer Customers)
12.1 Principle
If you are a consumer, you have 14 days to exercise your right of withdrawal, without having to justify your decision, from the conclusion of the contract (for service provisions).
12.2 Exceptions – Digital Supply / Immediate Execution
The right of withdrawal may be excluded in certain cases, particularly when supply has begun with your prior express consent and, depending on the type of service, with acknowledgment of the loss of the right of withdrawal under legal conditions.
12.3 Start of Execution at Express Request
If you expressly request the start of execution before the end of the withdrawal period, the financial consequences provided by law may apply.
12.4 Exercising the Right
To exercise your right of withdrawal, you must notify your decision by an unambiguous statement (email or letter) to: fluencygopro@gmail.com
12.5 Refund
In case of valid withdrawal, refund of amounts paid is made without undue delay and no later than 14 days from receipt of your withdrawal decision (subject to legal conditions).

13) Legal Guarantee of Conformity (Digital Content/Services – Consumers)
When Services constitute digital content or digital services provided to a consumer, they must conform to the contract. Depending on the case, the professional is liable for defects of conformity appearing within two years after delivery (one-time delivery), or during the delivery period (continuous delivery), in accordance with applicable rules.
14) Intellectual Property
The Site and its elements (texts, trademarks, logos, content, interfaces, etc.) are protected. Any unauthorized reproduction, representation, adaptation, or exploitation is prohibited.
15) Prohibited Behavior
The following are prohibited:
- Interfering with the proper functioning of the Site (attacks, scans, overloads, etc.)
- Attempting to access unauthorized areas
- Using the Site for illegal or fraudulent purposes
- Infringing on third-party rights or security
16) Liability
The Publisher implements reasonable means to ensure Site access and security, without guaranteeing the complete absence of errors, interruptions, or anomalies.
In any case, the Publisher's liability may only be engaged within the limits provided by law and for proven direct damages.
17) Termination / Account Deletion
The Registered User may request deletion of their account by sending an email to fluencygopro@gmail.com
The Publisher may suspend or delete an account in case of violation of the Terms or abusive use, after warning when possible.
18) Consumer Mediation (Consumers)
In accordance with the Consumer Code, any consumer may resort free of charge to a consumer mediator for the amicable resolution of a dispute.
19) Online Dispute Resolution (EU)
Note: the European online dispute resolution platform (ODR) has been closed (discontinued) as of July 20, 2025.
20) Applicable Law – Disputes
These Terms are subject to French law. In case of dispute, the User is invited to contact the Publisher first to seek an amicable solution, then, if necessary, to resort to mediation and/or competent courts.
